Please read the terms carefully before viewing or purchasing courses or associated materials.

Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:
“Website”: means the website that you are currently using, sales-dynamics.com and any sub-domains of this site;
“Content”: means any text, graphics, images, audio or video and any other form of information capable of being stored in a computer that appears on or forms part of this Website
“Student”: means any person who has approved access to Paid Content;
“Group Manager” means any third party that assigns Students to Paid Content;
“Paid Content” means any on-line course materials that has been purchased by a Student or Group Manager;
“Payment Gateway” means any third part payment processor, e.g. Stripe;
“System”: means any online communications infrastructure that Mike Kingston Business Courses makes available through the Website either now or in the future. This includes, but is not limited to, web-based email, message boards and email links;
“You” means any person that accesses the Website and views or purchases any content or courses;
“We/Us/Our”: means Mike Kingston Business Courses.

  1. Declaration
    Mike Kingston Business Courses owns and maintains the sales-dynamics.com website, all courses and other linked and related materials for the use of its customers, Students, Group Managers and other site users or visitor upon agreement to the following terms. Use of this website and the courses indicate acceptance of these “Terms of Use” and forms a binding agreement between you and Mike Kingston Business Courses. If you do not agree to these terms, do not use this site or purchase the courses or other services or materials.
    All the course videos and supporting materials are the property of Mike Kingston Business Courses and may only be used in the manner detailed in these Terms of Use Agreement.
  2. Use of Course Materials
    2.1. Students of Paid Courses have access to their course or courses within a period of 12 months from the date of purchase. Paid Courses and associated materials are for the sole use of Students purchasing a course or for Students assigned to a course through a Group Manager or others as approved by Us. Copying any part of the course videos or materials or posting the course videos or materials on any other website or computer network is strictly prohibited. Permission to use course videos and related material in any other way must be obtained in writing from Us at Email: admin@sales-dynamics.com

    2.2. As a student you may view and read all materials that are part of the course or courses you have purchased. You may download the associated materials designated for download and print these materials for your personal use in taking the courses. You may not copy, share, publish or in any manner distribute the course videos, or materials, or your login or password, or links to courses or associated materials to any other person or organisation.

    2.3. As a Group Manager you may only assign courses to users who are employed by your own business or organisation. You may not copy, share, publish or in any manner distribute the course videos, or materials, your login or password or any Student login or password or links to courses or associated materials to any other person or organisation. Any breach of these Terms of Use automatically terminates your authorized use of the Website and the Website contents.
  3. Services, Pricing and Availability
    3.1. No part of this Website constitutes a contractual offer capable of acceptance. Your order for Services constitutes a contractual offer that We may, at Our sole discretion, accept or reject.

    3.2. The Fees for Services are as set out on the Website at the time you purchase. The Fees are exclusive of any country or any other local taxes that may be applicable at the time of purchase and are added at the point of payment.

    3.3. We reserve the right to change prices and alter or remove any special offers from time to time and as necessary.

    3.4. Any fees charged by your debit or credit card provider in connection with your purchase of Services are for your own account and We shall not be responsible for these.

    3.5. You shall be responsible for all costs you incur in connection with your access onto any Online Course or in the execution of the course activities.
  4. Limitation of Liability
    4.1. While we endeavour to ensure that the information in the Website or courses and associated materials provided by Us on the sales-dynamics.com website is correct to the maximum extent permitted by law, we provide you with the training strictly on an ‘as is’ basis only.

    4.2. When your use of the materials, guidance or information from the Website or courses or any other associated materials, you do so entirely at your own risk and you assume all costs thereof.

    4.3. We make no warranty or representation that the Website content or Courses will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of Our content or courses.

    4.4. In no event will We be liable for any damages whatsoever (including, without limitation, those resulting from interruption of services or inaccurate information or advice) arising out of the use, inability to use, or the results from the use of the content or courses or all associated materials or information provided on the sales-dynamics.com site, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. You agree to defend, indemnify and hold Us harmless from any claims, losses, liability costs and expenses (including but not limited to legal fees) arising from your violation of any third-party’s rights. You acknowledge that you have only a limited, non-exclusive, non-transferable license to use the content or courses or associated materials.

No implied conditions, warranties or other terms apply (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description).

    4.6. Subject to clause 4.4 above, Our total liability arising from or in connection with these terms and conditions and in relation to anything which we may have done or not done in connection with these terms and conditions and the delivery of the Services and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to the payment received by Us in connection with the relevant online course or training materials in relation to which a dispute has arisen.

    4.7. Whilst We use reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, you are strongly advised to take responsibility for your own internet security, that of your personal details and your computers.
  5. Intellectual Property
    All Content included on the Website, text, graphics, logos, icons, images, sound clips, video, page layout, underlying code is the property of Mike Kingston Business Courses. By continuing to use the Website you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws. You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website or courses or associated materials unless otherwise indicated or unless given Our express written permission to do so

    This Website may contain links to Payment Gateways and other sites. Unless expressly stated, these sites are not under Our control or that of Our affiliates. We assume no responsibility for the content of such Payment Gateways or sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Website does not imply any endorsement of the sites themselves or of those in control of them.
  7. Your Account
    7.1 When you purchase Courses or Services on this Website you are required to create an Account which will contain your personal details and payment Information. We do not share your personal details with any third party other than the Payment Gateway that processes your payment.

    7.2. You cannot share your Account details, particularly your username and password. We accept no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.

    7.3. If You have reason to believe that your Account details have been obtained by another person without consent, you should contact Us immediately to suspend or change your Account.
  8. Cancellation of Accounts, Services and Refunds
    8.1. After 14 days following the purchase of a Service you have no right to a refund of the Service Fee. If within the 14 days cooling off period a Service is accessed by 30 percent or more you lose your right to cancel.

    8.2 If you wish to cancel your purchase you must notify Us by email to admin@sales-dynamics.com within fourteen days of the purchase date.

    8.3. Either Mike Kingston Business Courses or You may terminate your Account. If We terminate your Account, You will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing We reserve the right to terminate Your Account without giving reasons.

    8.4. Notwithstanding clauses 8.3 and 8.4 above there is no other right to cancel or vary your purchase of Services and any other cancellation and/or variation of course dates will be at Our entire discretion.
  9. Privacy policy

  10. Availability of the Website
    10.1. The Website is provided “as is” and on an “as available” basis. We use industry best practices to provide a high uptime including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or courses or content hosting will be free of defects and / or faults and we do not provide any kind of refund for outages.

    10.2. We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
  11. Changes to the Facilities and these Terms and Conditions
    We reserve the right to change the Website, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the Website following the changes. If We are required to make any changes to these Terms and Conditions by law, these changes will apply automatically to any Account or any purchases made by you in the future.
  12. No Waiver
    In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
  13. Third Party Rights
    Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between Us and You.

    14.1. All notices / communications shall be sent to Us by email at: admin@sales-dynamics.com. Such notice will be deemed received the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

    14.2. We may from time to time, if you opt to receive it, send you information about Our products and / or services. If you do not wish to receive such information, please click on the ‘Unsubscribe’ link in any email which you receive from Us.
  15. Law and Jurisdiction
    These Terms and Conditions and the relationship between you and Mike Kingston Business Training shall be governed by and construed in accordance with the Law of England and Wales and Mike Kingston Business Training and You agree to submit to the exclusive jurisdiction of England and Wales.
